Under Massachusetts law “A person shall have a right against unreasonable, substantial or serious interference with [their] privacy.” In the employment context, right to privacy issues arise regarding, for example, the release of confidential information contained in an employee’s personnel file to fellow employees or others, statements made to prospective employers by a prior employer, drug tests, computer monitoring, and video and audio surveillance.
